1. About these terms
These Terms and Conditions (the “Terms”) govern your use of the TurboGrading website, Chrome extension, APIs, dashboards, and related services (the “Services”), provided by TurboGrading Inc. (“TurboGrading”, “we”, “us”, or “our”).
By using the Services, you agree to these Terms. Our Privacy Policy explains how we handle personal information. If you do not agree to these Terms, do not use the Services.
If you accept these Terms on behalf of an organization, you must have authority to do so. A separate written agreement with TurboGrading controls where it conflicts with these Terms.
2. Accounts and access
TurboGrading is designed for educators and authorized educational staff. You must be at least 13 years old to use the Services. If you are below the age of majority where you live, you need authorization from a parent, guardian, or your institution, as applicable.
Provide accurate account information, keep your credentials secure, and use only accounts and assessment records you are authorized to access. Account owners manage their account settings and billing. Organizational access arrangements apply only where separately agreed.
You are responsible for activity under your account and for following your institution’s requirements for student data and external AI tools. Report suspected unauthorized access to info@turbograding.com.
3. Acceptable use
Use the Services lawfully and in accordance with institutional assessment, confidentiality, and academic integrity policies. You must not:
- Access another person’s account or data without authorization.
- Bypass security controls, rate limits, payment requirements, or usage limits.
- Upload malicious files or interfere with the operation of the Services.
- Submit content that infringes intellectual property, privacy, or confidentiality rights.
- Scrape or mass-download content outside features or APIs you are authorized to use.
- Reverse engineer, decompile, or disassemble the Services except as permitted by law.
4. AI-assisted grading
TurboGrading generates suggested marks and feedback from assessment content, submissions, rubric guidance, and instructions you provide. Outputs may be inaccurate, incomplete, or inconsistent. File support does not guarantee that every element, formula, visual, or requirement can be assessed.
You remain responsible for grading decisions. Review the submission, suggested marks, feedback, and any warnings or provisional results before relying on an evaluation. A provisional result indicates that further instructor review is needed.
Saving and publishing behavior depends on the LMS, assessment type, and extension settings. Enabling automatic saving or publishing authorizes the extension to perform those actions in supported workflows. Check your preferences before grading and review results in your LMS.
A result recorded in TurboGrading does not, by itself, confirm that it was saved or published in your LMS. You are responsible for checking the final evaluation there.
5. Plans, credits, and billing
Available plans, prices, allowances, and limits are shown on our plans page and at checkout. Review the amount, currency, billing interval, and applicable taxes before purchasing. Payments are processed through Stripe.
- Subscriptions: paid subscriptions renew automatically unless you cancel renewal. Cancellation normally takes effect at the end of the paid billing period; the dashboard shows the effective date.
- Grading credits: a completed assignment evaluation uses an assignment credit; grading an individual written response uses a question credit. Activating an exam can also use an exam credit. Reevaluating work may use another assignment or question credit, even if you do not save or publish the result in the LMS. A usable provisional assignment evaluation also uses an assignment credit.
- Allowances and purchased packs: recurring plan allowances reset for each billing period. Separately purchased grading credits are tracked independently and are not reset by a subscription renewal. Any product-specific limits are shown at purchase.
- Plan changes: upgrades may require a prorated payment. Downgrades normally apply at the next billing period. Review the charge and effective date displayed before confirming a change.
- Refunds: contact info@turbograding.com about billing errors or refund requests. Refunds are subject to the terms shown at purchase and applicable law.
Where offered, the Free Pilot has a limited duration and allowance and is available once per educator account. It does not renew into a paid subscription automatically.
Uninstalling the extension or stopping use does not cancel a subscription. Manage renewal through your account’s subscription controls or contact us for help.
6. Your content and privacy
You retain any rights you hold in content you submit. You grant TurboGrading a non-exclusive license to host, process, transmit, and display that content as needed to provide, maintain, and support the Services, including processing through service providers described in our Privacy Policy.
You must have the rights, permissions, and lawful authority needed to submit student work and other materials for this processing. Submit only the information needed for the assessment and follow any applicable notice or consent requirements.
Student-name privacy settings apply to dedicated name fields. They do not remove personal information from uploaded files, answers, feedback, or student identifiers. We may remove or restrict content that violates these Terms or applicable law.
7. Intellectual property
The software, designs, branding, and other materials that make up the Services belong to TurboGrading or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for your authorized purposes.
If you provide product suggestions or ideas, we may use them without compensation. This does not transfer ownership of your assessment materials to us.
8. Third-party services
The Services rely on or work with third parties, including LMS platforms, OpenAI, Stripe, and Google reCAPTCHA. Their availability and changes to their systems can affect TurboGrading. Their own terms and privacy policies may also apply to your use of those services.
TurboGrading is not responsible for third-party services or websites. References to D2L Brightspace or Blackboard describe supported workflows and do not imply endorsement by those providers.
9. Ending access
You may stop using the Services at any time. To end recurring charges, cancel subscription renewal separately. For account closure or data deletion requests, contact us using the details below.
We may suspend or terminate access if we reasonably believe you have violated these Terms, to protect the Services or other users, or to comply with law. Ending access does not remove payment obligations already incurred. Data retention is described in our Privacy Policy.
10. Disclaimers and liability
The Services are provided “as is” and “as available”. To the extent permitted by law, TurboGrading disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted operation, error-free results, or a particular grading outcome.
To the extent permitted by law, TurboGrading will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data arising from your use of the Services.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless TurboGrading and its affiliates, officers, directors, employees, and agents from claims arising from your use of the Services or violation of these Terms.
TurboGrading is not liable for delays or failures caused by events beyond its reasonable control. Nothing in these Terms excludes rights or liabilities that cannot be excluded under applicable law.
11. Changes and governing law
Features may change over time, and some may be offered as beta or preview releases. We may update these Terms and will revise the date above when we do. We will provide notice of material changes and obtain agreement where required by law.
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, subject to any mandatory protections that apply where you live.
