These terms and conditions govern access to and use of TurboGrading's Services.

These Terms apply to TurboGrading's website, Chrome extension, APIs, and related services (the "Services").

1. Acceptance of these Terms

These Terms of Service (the "Terms") explain the general terms and conditions that govern access to and use of the Services provided by TurboGrading Inc. ("TurboGrading", "we", "us", "our").

By accessing or using the Services, you acknowledge that you have read and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

If you are using the Services on behalf of an institution or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.

If TurboGrading and you (or your organization) enter into a separate written agreement (such as an order form or enterprise agreement), that agreement will control in the event of a conflict with these Terms.

2. The Services

The Services may include web applications, a Chrome extension, APIs, dashboards, grading and analytics features, and related support. Features may change over time, and some features may be offered as beta or preview releases.

3. Types of users

Users of the Services may fall into different categories depending on their role:

  • Account Owner / Customer: the person or organization that creates an account and (if applicable) purchases a plan. The Account Owner may invite additional users and manage billing and settings.
  • Authorized Users: educators, teaching assistants, administrators, or other individuals invited by an Account Owner or otherwise authorized to access the Services.
  • Institution administrators: where the Services are used through an institution, certain administrators may manage access, settings, or user provisioning consistent with institutional policies.

4. Eligibility, registration, and account security

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with authorization from a parent/guardian or your institution, as applicable.

When you register for an account, you agree to provide accurate information and keep it up to date. You are responsible for all activity under your account and for maintaining the confidentiality of your credentials.

If you register with an email address controlled by a third party (for example, your institution), you acknowledge that the institution may have administrative control over your account and may request access consistent with applicable law and institutional policy.

If you suspect unauthorized access to your account, notify us promptly at info@turbograding.com.

5. Acceptable use and user obligations

You agree not to misuse the Services and to comply with applicable laws and policies (including institutional academic integrity and assessment policies). You must not:

  • Access, attempt to access, or probe accounts, systems, or data you are not authorized to access.
  • Bypass or attempt to bypass security controls, rate limits, or access restrictions.
  • Upload malware or use the Services to distribute harmful code.
  • Reverse engineer, decompile, or disassemble the Services except as permitted by law.
  • Scrape, harvest, or mass-download content except through documented features or APIs you are authorized to use.
  • Use the Services in a way that infringes intellectual property rights or violates privacy/confidentiality obligations.

We may monitor for abuse, enforce rate limits, and suspend access to protect the Services and other users.

6. AI-assisted grading

TurboGrading may provide automated or AI-assisted suggestions (for example, draft feedback or scoring recommendations). These outputs are generated based on the inputs and configurations provided, may be incomplete or inaccurate, and are provided for assistance only.

Educators remain responsible for reviewing outputs and making final grading and assessment decisions. You must use professional judgment and follow institutional policy.

7. Fees, subscriptions, and payment

Some features may be available at no charge, while others require a paid subscription. Pricing, plan limits, and billing terms are displayed at purchase and may be described on our plans or pricing pages.

If you purchase a paid plan, you agree to pay the fees and applicable taxes. Subscriptions may renew automatically unless cancelled before the end of the current term. Payments are processed by third-party payment providers (for example, Stripe), and their terms may also apply.

Refunds (if any) are handled according to the terms shown at purchase and as required by law.

8. Intellectual property

The Services, including software, designs, text, graphics, and trademarks, are owned by TurboGrading or its licensors and are protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable right to access and use the Services for your internal purposes.

9. User content and feedback

You retain ownership of content you submit to the Services ("User Content"). You grant TurboGrading a worldwide, non-exclusive license to host, process, transmit, and display User Content as necessary to provide and improve the Services.

You represent that you have all rights and permissions needed to submit User Content and that your submission does not violate law or third-party rights. We may remove or disable access to User Content if we reasonably believe it violates these Terms or applicable law.

If you provide feedback, suggestions, or ideas, you agree we may use them without restriction or compensation.

10. Privacy and data protection

Our Privacy Policy explains how we collect, use, and protect information. When TurboGrading is used through an institution, the institution may control certain data and settings, and additional terms (such as a data processing addendum) may apply.

11. Third-party services and links

The Services may integrate with or link to third-party services (for example, payment processing, reCAPTCHA, analytics, or LMS platforms). We are not responsible for third-party services, and your use of them may be governed by their own terms and policies.

12. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access to the Services if we reasonably believe you have violated these Terms, to protect the Services or other users, or to comply with law.

13. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the extent permitted by law, TurboGrading disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.

14. Limitation of liability

To the extent permitted by law, TurboGrading will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, or data, arising out of or related to your use of the Services.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless TurboGrading and its affiliates, officers, directors, employees, and agents from claims arising out of your use of the Services or your violation of these Terms.

16. Force majeure

TurboGrading is not liable for delays or failures to perform due to events beyond our reasonable control, including network outages, natural disasters, labor disputes, and governmental actions.

17. Changes to the Services or Terms

We may modify the Services or these Terms from time to time. If we make material changes, we may provide notice through the Services or by other reasonable means. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

18. Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
